Fabrazyme Lawsuit |
BACKGROUND Genzyme currently holds the exclusive manufacturing license to Fabrazyme, a life saving drug developed on tax dollars. However, Genzyme has rationed the drug to less than 50% of the dose or given nothing to newly diagnosed patients. Mount Sinai Hospital Inc. granted Genzyme this license without requiring a second source of manufacture in case Genzyme had difficulties manufacturing the drug. As a result of the actions of Genzyme and Mount Sinai, many patients have had a return of symptoms and some have been reported to have died. You may have a right to be compensated for your or your family member's injuries. Lawsuit: Patients who have been denied access to Fabrazyme or suffered on the reduced dosage, as well as their families, should be compensated for their injuries. We filed a lawsuit in the Western District of Pennsylvania against Mt. Sinai Hospital and Genzyme on March 10, 2011. The complaint is available here: Hochendoner v. Genzyme. The Press Release regarding the lawsuit is available here: Fabrazyme Lawsuit Press release. Basis for lawsuit: This lawsuit is filed on a contigency basis, which means that there is no cost to the patients who sue, unless we win or settle. No patient is obligated to join; however if you do not join the suit, we highly recommend that you contact an attorney as soon as possible. It is possible that jurisdictions will require a lawsuit to be filed by June 1, 2011 (the beginning of the shortage) to avoid the statute of limitation which may bar any later filed cases. Contact information: It is my job to provide quality legal services for Fabry patients. If you have been injured or just if you wish to receive more information, I will be glad to talk to you at no charge. I want every Fabry patient to be fully informed of their rights, whether or not they choose to join the suit. If you are interested in joining the suit, or would like more information, please call me (Allen Black) at 412-908-3268. You can also email me at allen@patentlawyersite.com. |
